Mayor O’Dell called the meeting to order at 7:00 PM and declared a quorum was present.

The minutes of December 8, 2009 were accepted, as presented, by acclamation.

December 2009 financial report was reviewed. Report was accepted by acclamation.

Avoca Fire & Rescue

Bowen presented Fire Chief Elliott’s report dated January 11. Department will work with the Town and come up with an action plan on generator/emergency shelter; working on ISO information; training classes have started at the fire station and work is in progress having Avoca residents annual fire dues on their property tax.

Bowen reported Frankie, Rachel Ernst and herself attending a meeting with Benton County clerk on January 5. Due to lack of and incorrect information from the County, Ordinance No 83 passed in December will not be acceptable for placing the dues on ballot. Bowen to contact Slinkard Law Firm to have new ordinance drafted, which will also repeal Ordinance 83. All information must be turned into the County Clerk by March 1.


Larry Slingsby, zoning official, reported J & S Auto, Inc. is acquiring more space for his current business, located at 487 S. Highway 62. He will be adding the area that was leased by Derick Akins for Akins Motorsports.
Mayor O’Dell reported a Planning Commission meeting has not been scheduled.

Committee Reports


Isaias Martinez will present a quote to clean out ditch line on south side of Benton County 74/Woods Lodge Road.

Mayor O’Dell reported laying the blocks to help with the water flow in the north BC 74 ditch line has not been started

Mayor O’Dell reported he met with three (3) county officials concerning the hazard caused by the ‘gushing rock’ just east of McClinton Anchor. County will do the work and Avoca will pay $2200 for materials from McClinton Anchor. County’s plans are to install a 2’ X 4’ concrete whistle during spring break

Mayor O’Dell to look at the dead-end on Shepherd Road, where Rader Drive was closed, to see what can be done about the pot holes, caused by trash trucks, etc turning around

Due to the recent ice and snow, it was discussed the Town needs to look into a sand/salt spreader

Street and traffic lights – all in working order

3. Park

a. Veteran’s memorial – on hold

  • b. Mayor O’Dell reported Chapter C –Vietnam Vets/Legacy Vets will hold a bike show and swap meet Saturday, April 10 at the Town Park.
  • c. Resolution No. 01-10 was read in its entirety. Resolution authorizes Mayor O’Dell to submit an application for grant funding to the Arkansas Department of Parks and Tourism. Ald. Hansen, seconded by Ald. Shields, moved Resolution No. 01-10 be approved. All approved. Motion carried.
  • Bowen reported the grant request for rubber mulching for the two (2) playground areas will be submitted prior to the January 22 deadline
  • 4. Town web site – Bowen reported Erik Weems is in process of assembling and designing new website.


Business Permits

  • 1. Business permit was issued to Jason Oaks for NWA Imports located at 489 S. Highway 62. Nature of business will be retail.
  • 2. Bowen reported business permits have been renewed, for 2010, for the following businesses: Avoca One Stop, Williams Tree and Lawn Svc. Inc., Benton County Water District No. 1, Superior Dock Co., Ironwood Shredding, Austin Welding Service Inc., Freedom Fire Pro LLC, Charley’s Tree Service, Latham Cabinets, Inc., Avoca Quarry, GMI Glazing Specialties and Trotter’s Tree Service.

Building permits – none issued

Unfinished Business:

1. Municipal court and police department – no report

2. Unsightly conditions –

a. Unsightly conditions - S & K Dirtworks and McClelland & Sons - Old Wire Road; vacant trailer off Shepherd and Rader Drive – no report

New Business:

Information from various towns/cities in the state concerning the details of business licenses/permits – no report

Bowen reported she attended the Legislative Joint Auditing Committee meeting on Thursday, December 10 in Little Rock.

Bowen reported NWA Newspapers does not offer contract for legal advertisements.
Council agreed on a figure of $1,000 as the minimum cost/value for items to be defined as fixed assets. Bowen to draft resolution concerning this information for February council meeting.

Ald. Pinkley, seconded by Ald. Hansen, moved the meeting be adjourned at 8:30 PM. All approved. Motion carried.
