Mayor O’Dell called the meeting to order at 7:00 PM and declared a quorum was present.

The minutes of March 9 were accepted, as presented, by acclamation.

March 2010 financial report was reviewed. Report was accepted by acclamation.

Avoca Fire & Rescue

Bowen presented Fire Chief Elliott’s report dated April 12. The department met with ISO grader, Gayland Lightfoot, on March 30 and 31st. It could take up to six (6) months to get the results; department has contacted the Red Cross to meet with them concerning using the community building as an emergency shelter; received $10,000 grant for a thermal image camera; in the process of getting another brush truck in service; Town will supply drinks for June 19 annual BBQ; election May 18.


The Town received a letter, dated March 15, advising VAS board of directors are beginning procedures for the transfer of our area’s emergency medical services from VAS to NEBCO VFD.


Larry Slingsby, zoning official, reported the partial log building at Beaver Storage is gone.
The planning commission met March 30 and was sworn into office by JP Marge Wolfe. They adopted Town of Avoca Zoning Code 2010 and are working on a planning area map and by-laws. Commission will meet again April 27.

Committee Reports:

Spring Clean-Up will be Saturday, May 15th. Bowen reported the County will provide a trailer for passenger tires and Great American Clean – Up will provide the Town with banner, gloves, trash bags and tee shirts.


Mayor O’Dell reported he has laid 4 or 5 flow devices in the north ditch line on BC 74/Woods Lodge Road. Due to dry weather they have not been tested.
Mayor O’Dell has not contacted Benton County road department to see when they will clear the trees, install the concrete whistle and do other necessary work on BC 74/Woods Lodge Road.

No report on looking into a sand/salt spreader.

Street and traffic lights – all in working order

4. Park

A. Veteran’s memorial – Mayor O’Dell presented his plans for the Veteran’s Memorial to be placed in front of Town Hall and estimated the entire project to cost approximately $8,000. Various veteran groups are soliciting for donations. Mayor O’Dell would like to have project completed by the end of August.

B. It was agreed the woods chips we could get from Good Wood are not exactly what we need in the playground areas. Ald. Hansen estimated the cost for the rubber mulching for the small playground area would be approximately $6,000. Ald. Pinkley, seconded by Ald. Hansen, moved the Town allocate the monies for the job. 6 inches of mulch, will compact to 4 inches. Town to use County inmate labor and put down weed barrier, before mulch is laid. Ald. Hansen seconded the motion. All approved. Motion carried.

C. Rachel Ernst, Avoca Fire & Rescue, will attend our May council meeting to present the idea of the fire department putting vending machines in the park, for a fund raiser.

D. Mayor O’Dell reported Benton County Water has had the ditch line on the south side of the park dug out.

E. Bowen reported the porta potty has been set. Pad will be poured for the portable unit and secured.

F. Apple Shed recipient was chosen.

5. Town web site – Bowen reported the assembling and designing of new website is complete.

6. Farmer’s Market – Bowen reported the vendors had an organizational meeting on March 29th. Becky Hedden and Diana Reeves are now the contacts for the Market. They will open their own checking account and work as their own entity, with the Town’s support. Market will start May 1 in the parking lot at ‘Rose Street Warehouse’.

Business Permits

1. Bowen reported Fulton Properties Ltd. /Fulton Equities, Ltd. has renewed their 2010 business permit.

2. McClelland & Sons has been contacted concerning their business permit renewal and said they have leased their building. They are to provide contact information for the renters.

Building permits

none issued

Fees for building permits were discussed. Ald. Hansen, seconded by Ald. Pinkley, moved the fees be as follows: Open Structure - $25; Closed Structure less than 1500 square feet - $50; Closed Structure greater than 1500 square feet - $75. All approved. Motion carried.

Unfinished Business:

New Business:

Information from various towns/cities in the state concerning the details of business licenses/permits – no report

Bowen reported lease application and lease agreement forms have been completed.

An ad has been placed in the paper advertising the building is for lease. Length and amount of lease was discussed. Resolution 05-10, a resolution authorizing Mayor O’Dell and Recorder-Treasurer Bowen to execute commercial lease agreement documents for the lease of 40 X 100 metal building located at 109 W. Rose, was read.
Ald. Hawkins, seconded by Ald. Hansen, moved Resolution 05-10 be approved. All approved. Motion carried.

James, with J & S Auto and R & J’s Post & Pawn, looked at the building today for a possible repair and service center for RV’s, but also wanted to rent the empty lot adjacent to the park. Council agreed, if interested, they would sign a 2 year lease for $800/month for building and empty lot. Security deposit of $800; would deduct ½ month’s rent if they cleaned the building.

Ordinance No. 85, an ordinance authorizing payments for services to members of the Avoca Planning Commission/ Board of Zoning Adjustments for attending meetings of the planning commission and board of adjustment, was placed on its second reading. Ald. Hawkins, seconded by Ald. Hansen, moved the second reading of Ordinance No. 85 be accepted. All approved. Motion carried.

Ald. Pinkley, seconded by Ald. Hansen, moved the meeting be adjourned at 9:10 PM. All approved. Motion carried.
