Minutes of Re-scheduled Regular Meeting

Present: Mayor Thomas O’Dell, Recorder-Treasurer Diane Bowen

Guests: Larry Slingsby, Jeanne Varnell, Christine Pinkley

Mayor O’Dell swore Kathy Hansen, Darlene Gregory, Kathleen Shields, Dennis Pinkley and Jordan Sullivan into their alderman positions. Bowen to file aldermen’s completed official oaths of office and certificates of election with the Benton County Clerk.

Mayor O’Dell and Recorder-Treasurer Diane Bowen were sworn into office on January 1st.

Mayor O’Dell called the meeting to order at 7:00 PM and declared a quorum was present.

Public comments

1. Christine Pinkley noted after the Christmas lights were taken down in the ‘apple shed’ pavilion, the walking trail got very dark around 5:30. She asked that the council consider better lighting at the park at night. After discussion, Mayor O’Dell said he could put the pavilion lights on a timer, during the winter. Ald. Hansen said lighting could be put in the 2012 park budget.

2. Jeanne Varnell presented pictures she had taken on December 19th showing a car parked on the south side of Hobbs, in the fire lane, and a car parked on the grass at a residence on Hobbs Road. Larry Slingsby, zoning, presented to the council pictures and dates and times he has driven Hobbs Street since the December 14 council meeting. He also gave all residences a letter concerning ‘not to park on the south side of Hobbs Road, due to being a fire lane’. Bowen to contact Attorney Slinkard to obtain legal counsel concerning if the town must have an ordinance concerning fire lanes. Whether a deputy can enforce town ordinances was discussed

The minutes of December 14 were accepted, as presented, by acclamation.

December 2010 financial report was reviewed and approved, as presented, by acclamation.

Bowen reported the 2011 budget was published.

Planning

a. The commission’s regular meeting is Tuesday, January 25. Jeff Hawkins, NWA Regional Planning Commission, is to supply samples of sub-division regulations. A master street plan is a pre-requisite to the adoption of sub-division regulations.

b. Parcel split for George Panter, Assembled Products, is completed.

c. Jordan Sullivan recommended and asked Mayor O’Dell to take into consideration David Dodson as a new member of the planning commission. Mr. Dodson lives in Deer Haven sub-division, which is in Avoca’s proposed planning area.

Zoning

a. Bowen reported she has a meeting with Attorney Slinkard this week concerning Mr. Stewart. Slingsby has taken pictures of the original trailer being torn down and pictures of the mobile home that was recently moved onto his property.

b. Slingsby reported he had placed a note on the hitch of a trailer home that was parked on the Rose Street Warehouse property.

c. Slingsby noted he had one residence at 291 Hobbs Road that would not remove car parked in fire lane, when asked to.

Committee Reports:

1. Clean-Up–Spring cleanupwill be held in May.

2. Streets

a. Mayor reported he has not contacted Isaias Martinez concerning the concrete work that needs done on the south ditch line on BC 74.

b. Surplus sand/salt spreaders and single axle dump truck – no report

c. Mayor O’Dell has contacted Ronnie Smith concerning fines needed on the end of Shepherd Road, but has not been completed.

d. Snow/ice removal – Bowen reported on the information she got from Garfield, Pea Ridge and Little Flock concerning snow and ice removal. All three of the cities have the necessary equipment and operator. Ald. Gregory reported on information she had gathered and also suggested contacting McClinton Anchor for some help or advice. Street and traffic lights – all in working order

5. Town web site – Need to submit some updates, including ordinances.

Permits:

Business Permits

  • a. No permits issued in the past month for new businesses
  • b. Six (6) renewals for 2011 issued to Hoss’s Mobile RV Repair, Charley Tree Service, Freedom Fire Pro, Ironwood Services, Hawkins PC & I, Inc. and Benton County Water. Second notices will be sent in January.
  • c. Agenda item ‘what constitutes the need for a business license’ tabled on a motion by Ald. Pinkley, seconded by Ald. Hansen. All approved. Motion carried.

Building permits – none issued

Unfinished Business:

  1. McClelland & Sons, Inc. – Bowen to send letter to Mr. McClelland when business permit renewals are sent out.

New Business:

1. Annexation – Assembled Products – Bowen to provide surveyor, Ronald Ridout, with the Town limit bounds on the south end of Avoca.

2. Bowen reported Roll Off Services, Inc. bills quarterly for trash service and will take over billing, from Benton County Water, in April 2011. Roll Off Services has said they will do the public notice and will get addendum to the Town’s contract worked up.

3. Ald. Hansen, seconded by Ald. Pinkley, moved Ordinance No. 86, an ordinance approving the Avoca planning area, be placed on its second reading by title only.

Motion carried.

Ordinance No. 86 was read by title only.

Ald. Hansen, seconded by Ald. Pinkley, moved the second reading of Ordinance No. 86 be accepted.

Motion carried.

Ald. Gregory, seconded by Ald. Shields, moved Ordinance No. 86 be placed on its third and final reading by title only.

Roll Call: AYES: Gregory, Shields, Sullivan, Pinkley, Hansen

Ordinance No. 86 was read by title only for its third and final reading.

Ald. Hansen, seconded by Ald. Pinkley, moved the third and final reading of Ordinance No. 86 be approved.

4. Ald. Shields, seconded by Ald. Sullivan, moved Ordinance No. 87, an ordinance adopting, by reference, a certain technical code entitled: “Town of Avoca Zoning Code 2010” be placed on its second reading by title only. All approved. Motion carried. Ordinance No. 87 was read by title only. Ald. Sullivan, seconded by Ald. Shields, moved the second reading be approved. Roll Call: AYES: ALD Sullivan, Shields, Gregory, Hansen, Pinkley Motion carried.

Ald. Gregory, seconded by Ald. Sullivan, moved Ordinance No. 87 be placed on its third and final reading, by title only. All approved. Motion carried. Ordinance No. 87 was read by title only. Ald. Sullivan, seconded by Ald. Gregory, moved the third and final reading of Ordinance Nol. 87 be approved. Roll Call: AYES: Sullivan, Gregory, Hansen, Shields, Pinkley. Motion carried.

5. Bowen reported the clerk orientation in Little Rock has been re-scheduled to January 19 in Little Rock, due to the weather.

6. Ald. Hansen, seconded by Ald. Sullivan, moved to table the review of meeting procedures until February meeting. All approved. Motion carried.

7. Avoca Civic Guide will be updated in March, after business permit renewals are due.

8. Bowen to look into the Reverse 911 test that was done by the County. Most council members said they did not receive the call.

9. Bowen reminded council their statements of financial interests are due by January 31.

Ald. Hansen, seconded by Ald. Shields, moved the meeting be adjourned at 8:30 PM. All approved. Motion carried.
