Minutes of Regular Meeting

Mayor O’Dell called the meeting to order at 7:07 PM and declared a quorum was present.

Pledge of Allegiance.
Moment of silence.

The minutes of January 10 were accepted, as presented, by acclamation.

January 2011 financial report was reviewed and approved, as presented, by acclamation.

The commission’s next regular scheduled meeting is Tuesday, March 29. Jeff Hawkins, NWA Regional Planning Commission, is to supply samples of sub-division regulations. A master street plan is a pre-requisite to the adoption of sub-division regulations.
Officers to be elected.

Jordan Sullivan would like to have a meeting in February, if information from NWA Regional Planning Commission is received.

Zoning

a. Bowen reported she turned all the information, concerning Leonard Stewart’s mobile home, over to Attorney Slinkard on January 13. Attorney suggested since the trailer is not occupied, not installed and not connected to utilities the Council wait before taking action. He also wanted to see if we could get a picture of the manufacture label/tag to see if the trailer was manufactured before 1976. Ald. Shields, seconded by Ald. Pinkley, moved the attorney send a letter now advising Mr. Stewart he is out of compliance and the trailer be removed from the property. All approved. Motion carried. The trailer was also moved into town without getting a permit.

b. Hobbs Road – Ald. Gregory reported she has observed Hobbs Road approximately twenty (20) times over the past month and never saw a car parked in the fire lane. An ordinance prepared by Attorney Slinkard, prohibiting parking on the south side of Hobbs Road was reviewed. Mayor O’Dell said he would like to talk to the City of Rogers and also contact the County to see if they would/could enforce the Ordinance. Ald. Hansen, seconded by Ald. Shields, moved the introduction of the ordinance be tabled. All approved. Motion carried.

c. Zoning official, Larry Slingsby, reported he delivered another letter to the residents on Hobbs Road explaining he delivered the first letter, without contact information.

Committee Reports:

Clean-Up – Spring cleanup will be held Saturday, May 15th. Bowen reported she had sent application to Great American Clean Up.

Streets

Concrete work that needs done on the south ditch line on BC 74 was tabled until spring on a motion by Ald. Hansen, seconded by Ald. Sullivan. All approved. Motion carried.

Surplus sand/salt spreader and single axle dump truck and snow/ice removal – no report. Council agreed before next fall we need a plan of action.

a. Ald. Hansen working on sign for depot pavilion.

b. Mayor O’Dell to place timer on the lighting to the apple shed pavilion.

c. Bowen reported she had contacted Ron Brown, RJR Enterprise, for suggestions on how to secure the soccer goals. Mayor O’Dell to take care of the project using spiral stakes and chain.

5. Town web site – Herb Hawkins to be removed from site as alderman and Jordan Sullivan added.

Permits:

Business Permits

  • Business permit application and fee was received from Joint Construction LLC. Applicants are Todd Wallace and Shane McClelland; place of business 849 Old Wire Road; business activity is construction and welding. Ald. Shields, seconded by Ald. Hansen, moved the application be approved. All approved. Motion carried.
    This property has been sent letters to clean up the property and Bowen was instructed to send another certified letter to both property owner and business permit applicant.
  • Thirteen (13) renewals for 2011 business permits were issued to Avoca Auto Sales, GMI Glazing Specialties, Inc., Avoca One Stop, Williams Tree & Lawn Service, Inc., Trotters Tree Service, APAC Central – Avoca Quarry, Wingate Outdoor Advertising, Inc., Clear Channel Outdoor, K & K Auto Sales, Kimball Automotive, Latham Cabinets, Inc., Beaver Storage LLC, and Chrysalis Studio.

Building permits – Larry reported there is one pending building permit.

Unfinished Business:

  1. Annexation – Assembled Products – Bowen reported she sent requested information to surveyor, Ronald Ridout, concerning the possible annexation of George Panter’s property.
  2. Bowen reported Deffenbaugh Industries, formally Roll Off Service Inc., will take over the trash billing from Benton County Water on April 1. They should provide an addendum to our contract prior to our March meeting.
  3. New civic guides (brochures) will be updated in March, after business permit renewals are completed.
  4. Reviewing ‘what constitutes the need for a business license’ was tabled on a motion by Ald. Hansen, seconded by Ald. Shields. All approved. Motion carried.

New Business:

  1. 1. Bowen reported she attended the clerk orientation in Little Rock January 19th.
  2. A resolution setting forth meeting rules of the Town Council was reviewed. A few changes were suggested and council to submit comments concerning changes/suggestions they would like to see, to Bowen prior to March meeting. Ald. Pinkley, seconded by Ald. Hansen, moved the resolution be tabled until March. All approved. Motion carried.
  3. Bowen reported she had contacted Marshal Watson concerning the Reverse 911 test that was done by the County. Their system is currently set up so that if an answering machine receives the call, they do not retry. Ald. Shields and former Ald. Hawkins did answer the test call. Bowen to resend the county’s website to the council, where they can set up their individual profiles, by adding cell phones, etc. to the system.
  4. Dogs – Sheppard Road – no action – Ms. Barnes did not attend
  5. Brian Mencl to be contacted concerning the unsightly conditions of his property at 309 Sheppard Road.

Ald. Hansen, seconded by Ald. Shields, moved the meeting be adjourned at 9:00 PM. All approved. Motion carried.
