Minutes of Regular Meeting

Present: Mayor Thomas O’Dell, Recorder-Treasurer Diane Bowen

Mayor O’Dell called the meeting to order at 7:00 PM and declared a quorum was present.

Pledge of Allegiance.
Moment of silence.

The minutes of December 15, 2011 re-scheduled regular meeting were accepted, as presented, by acclamation.

December 2011 financial report was approved, as presented, by acclamation.

Avoca Fire & Rescue – No report

Planning - Jordan Sullivan reported the next regular meeting for the planning commission is January 31.  Loretta Hawkins and Jordan Sullivan’s planning commission terms expired the first of 2012. Mayor O’Dell reappointed Hawkins and Sullivan to the commission.  Council approved.  Mayor O’Dell has talked with resident Jay King about becoming a member to replace Lynn Daves.  Mr. King has been invited to the January 31 meeting.

a. Bowen reported a building permit was issued to Stanley Martin at 415 Dancer Road.  Permit was for a 30’ X 20’ addition to existing building.
b. Bowen to send a letter to Brian Mencl at 309 Sheppard Road concerning violations of unsightly ordinance and zoning code. 

Committee Reports:

  1. Clean-Up – Spring cleanup will be in May.
  2. Streets

a. Mayor O’Dell reported the work being done by J. Johnson Construction on Rader Road and the south side of BC 74 is still progressing. 

b. Mayor O’Dell reported the drainage work to be done on Orchard and Center Street by J. Johnson Construction has not been started. 

c. Bowen reported she had contacted the County about not using their side winder in the town limits, due to the fact the limbs are being ripped and are filling the ditches.  The County’s sidewinder showed up on Prairie Creek Road and was stopped.  After talking with Jack Brown, employee of County Road Department, the blades have been sharpened and the ditch line on Prairie Creek Road cleaned up.  Since the County will be doing some snowplowing, they may need to do some trimming but will keep the ditches cleaned out.

3.   Street and Traffic lights – Street light out on Dancer/Old Wire Roads.  Has been reported to Carroll Electric.

4.   Park

a. Sign for the depot pavilion is work in progress.

b. Marble tiles on the monument have been sealed.

c. Hardware on banners has been changed out and the everyday banners put back up.

d. Mayor O’Dell is working on dumpster screening.

5.   Town web site – up to date

Business Permits

  1. Derick Akins has been issued a business permit for Lucky’s at 499 South Highway 62.  Business is arcade/game room.
  2. Bowen reported the following seven (7) businesses have been issued their permit renewals for 2012:   APAC-Central – Avoca Quarry, Stephen Eberle Construction, Freedom Fire Pro, LLC, Benton County Water District No. 1, Chrysalis Studio, G.M.I. Glazing Specialties Inc., and Charley’s Tree Service.

Building permits – Stanley Martin, 415 Dancer Road

Unfinished Business:

  1. Town of Avoca vs. Leonard and Mindy Stewart - Bench trial scheduled for Wednesday, February 8 at 1 PM.

New Business:

1. The draft agreement between the Town and NEBCO EMS for EMS services was reviewed by Council.  Changes were suggested and Bowen to forward those to NECBO for review.

2.  Resolution No. 01-12, a resolution adopting the 2012 budget for the Town of Avoca was read.  Ald. Hansen, seconded by Ald. Pinkley, moved the resolution be approved.  All approved.  Motion carried.

3.  Resolution No. 02-12, a resolution setting forth the meeting rules of the Town council for the Town of Avoca was read.  Ald. Shields, seconded by Ald. Sullivan, moved Resolution 02-12 be approved.  All approved.  Motion carried.

4.  Resolution No. 03-12, a resolution appointing Howard L. Slinkard, P. A. for the Town of Avoca, was read.  Ald. Hansen moved the hourly rate for legal services be at the rate of $150 per hour.  Ald. Gregory seconded the motion.  All approved.  Motion carried.  Ald. Hansen, seconded by Ald. Shields moved Resolution 03-12 be approved.  All approved.  Motion carried.

5.  Bowen advised Council ‘Statement of Financial Interest’ are to be filed with her by January 31st.

6.  Bowen reported twenty-one (21) people did receive the BC Alert concerning the Christmas parade.  To receive news/events such as parade, picnic, etc. you must sign up for “News and Events”. Bowen provided information to the council on how to sign up for news/events.  The information will also be posted and put on website.

7.  Bowen reported she has made several attempts to contact Wal-Mart ‘new store real estate’ contact she has been given and will continue.  

8.  Letters to be sent to Lynn Fulton and Tim McDougal concerning the home fires they have recently had and advise them of the 2010 Avoca Zoning Code.

9.  Vacant homes in the town limits were also discussed.

10.  Bowen to advise Hoss Cameron of Hoss’s Mobile RV Repair his sign on Old Wire/Lester Road is in violation of zoning code.

Ald. Shields, seconded by Ald. Pinkley, moved the meeting be adjourned at 8:22 PM.  All approved.  Motion carried.
