Minutes of Regular Meeting

Present:

Mayor Thomas O’Dell, Recorder-Treasurer Diane Bowen
ALD:  Jordan Sullivan, Nanette Barnes, Darlene Gregory, Kathleen Shields, Dennis Pinkley      

Guests: Kathy Hansen

Mayor O’Dell swore Aldermen Sullivan, Barnes, Gregory, Shields and Pinkley into office.

Mayor O’Dell called the regular meeting to order at 7:20 PM and declared a quorum was present.
Pledge of Allegiance.
Moment of silence.

Minutes of December 2011 were approved, as presented, by acclamation.

December 2012 financial report was reviewed and approved, as presented, by acclamation. 

Avoca Fire & Rescue – Bowen presented Chief Elliott’s report.  The department made 411 runs in 2012 and has 23 active firefighters.  Elliott asked that the limbs next to streets be cut back, due to the damage they are causing on the trucks.  He also asked if the Town can get the word out on the need for having address numbers legible and visible from the street fronting their property.  Annual picnic will be September 21st.  Agreement for Avoca Fire & Rescue services for 2013 has been signed by Mayor O’Dell and David Whitlow, President Avoca Fire and Service.

Planning/Zoning –
Planning

  1.  Jordan Sullivan reported the Planning Commission’s next meeting will be January 29th. 
  2. Mayor O’Dell received a letter of resignation from Ald. Barnes for her position on the planning commission, due to being elected alderman to the Avoca Town Council.  Ald. Sullivan, seconded by Ald. Pinkley, moved to accept Ald. Barnes resignation.  All approved.  Motion carried.
  3.  Mayor O’Dell to appoint a new member to the Planning Commission.
  4.  Bowen reported Dollar General Project died, due to not being able to get a clear   title on the property.
  5.  Kathy Hansen showed an interest on being on planning committee.

Zoning – Zoning Official Shirley McDaniel presented her monthly report.

Committee Reports:

  1. Clean-Up - Next clean-up will be May 11, 2013.
  2. Streets -     
    1. Mayor O’Dell reported he has still not obtained road specs, but is going to contact Frankie Guyll, to see if he can get a copy from Rogers.
    2. Mayor O’Dell will also contact Mr. Guyll on cross walk specs.
    3. Pot holes are on corner of Rose and Main Street and also on south side of Rose Street between Hwy 62 and railroad.
    4. Sidewalk program was discussed.
  3.  Street and Traffic lights
    1. Ald. Shields is taking care of getting a street light at corner of Lester and Old Wire.
    2. Mayor O’Dell to contact Ar. Highway Department about getting ‘turn’ signals on our traffic light.
  4.  Park
    1. a. Sign for ‘depot pavilion’ is completed and ready to hang.
                       b. Avoca Disc Golf Course – Kathy Hansen reported the tee signs need to be             installed, one sleeve needs repaired or replaced and etiquette sign needs ordered and installed.
                       c. Benches, tables, and trash receptacles have been ordered and will be installed    by RJR Enterprise.     
                      d. Hansen mentioned the apple trees need to be sprayed and a couple need replaced that have died.  Mayor O’Dell is going to get some Paw Paw trees and make a grove where the huge tree was lost in high winds.
                      e. The bike race tentatively scheduled for May 5 was changed to May 4th.     Council saw no problems with the date change.     
    5.   Town web site – up to date
Permits:
Business Permits
     1.  Bowen reported nine businesses have renewed their business licenses to date.
     2.  New business permit was issued to Don’s Canopies & Metal Products at 849 Old         Wire Road.

Building permits none issued      

Unfinished Business:

  1. Consulting engineer – no action taken
  2. Address/zip code – no contact has been made with Tim Marion.

New Business:

  1. Performance evaluations for non-elected positions – to be taken off agenda.
  2. Dogs – No action was taken on the Ordinances provided from Benton County.
  3. Mike Hartwig’s property was discussed again.  Price of $25,000 was discussed.  Ald. Sullivan, seconded by Pinkley, moved Bowen invite Mr. Hartwig to the February council meeting.  All approved.  Motion carried.
  4. Bowen reported the Town had received a ‘comments of public officials’ form from the Alcoholic Beverage Control Division.  Mike McKenzie, Avoca One Stop, has applied for a New Retail Beer Off Premises permit.  Reply given to the ABC Division was the Town of Avoca does not object, as long as everything is done legally.
  5. The unsightly and unsanitary conditions at the duplexes on Rose Street were brought up again.  A letter, dated December 27, was sent to Benton County Environmental Director, Chris Ryan, requesting continued support from their office. 
  6. Resolution No. 01-13, a resolution supporting legislation to improve sales tax collection information from the Arkansas Department of Finance & Administration, was introduced and read in its entirety.  Ald. Gregory, seconded by Ald. Shields, moved Resolution No. 01-13 be accepted.  All approved.  Motion carried.
  7. Mayor O’Dell appointed the following committees: 
    Streets:  Mayor O’Dell; Street/traffic lights:  Ald. Shields, Ald. Sullivan; Park – Ald. Barnes, Ald. Pinkley; Special events/decorating:  Ald. Gregory

Ald. Shields, seconded by Ald. Sullivan, moved the meeting be adjourned at 9:30 PM. All approved.  Motion carried.
