Mayor O’Dell called the regular meeting to order at 7:00 PM and declared a quorum was present.
Pledge of Allegiance.
Moment of silence.

Added to agenda:  New Business – #4 Res 03-13   #5  Complaint & Offer   #6  Troy Built mower

The minutes of March 12 were approved, by acclamation. 

March 2013 financial report was reviewed and approved, as presented, by acclamation. 
2012 Financial Statement was approved by acclamation.

Avoca Fire & Rescue – No report
NEBCO EMS – Mayor O’Dell and Bowen attended the town hall meeting in Garfield, April 3, concerning the county wanting to start ambulance service for non-incorporated areas of Benton County.  Those in attendance wanted to keep our current service “as is”.

Planning/Zoning –
a. Jordan Sullivan reported the Planning Commission did not have a quorum for their March 26 meeting.  Public hearing for Dan Kessler was canceled due to required paperwork not turned in on time.  The committee did meet and progress is being made, b. Board of Zoning Adjustment and Planning Commission’s next meeting will be April 30.

Zoning – Zoning Official Shirley McDaniel presented her monthly report.  She has been working on letters to be sent to those with inoperable vehicles and abandoned structures.

Committee Reports:

  1. Clean-Up - Spring clean-up will be May 11, 2013. County will be providing trailer for passenger tires and Avoca Fire & Rescue will have a trailer for metal. 
  2. Streets -     
    1. Mayor O’Dell reported the cross walks need to be done in the spring. 
    2. Sidewalks were discussed. 
    3. Mayor reported David Olson and Larry Parrish have been hired for street and park maintenance and are working out very well. 

3.  Street and Traffic lights – all in working order

4.   Park

    1. The sign for ‘depot pavilion’ is ready to hang.
    2. Avoca Disc Golf Course – no update
    3. Ald. Barnes and R/T Bowen to meet with Kathy Hansen and walk the park to see what maintenance needs done.
    4. Mayor O’Dell planted Paw Paw trees in the park.
    5. ‘Easter Egg Hunt in the Park’ was another great success.
5. Town web site – up to date

Business Permits

    1. Council agreed a $25 renewal fee should be charged annually.  Bowen is checking into whether the fee can be added to our schedule of fees or if our ordinance has to be changed or amended.
    2. Bowen reported one letter has been sent to Stan Martin for conducting business without a business permit and unsightly conditions.  More letters to go out in the near future, concerning this subject.
    3. No new business permits have been issued.

Building permits none issued
Unfinished Business:

  1. Duplexes on Rose Street - Bowen reported Attorney Lisa Reeves from Bella Vista has withdrawn as attorney for Arkansas.  Bowen has sent pictures of the property to Texas attorney, David Jackson Wilburn II, and has asked him to keep us advised of when a new Arkansas attorney is hired.  Bowen has received several Ordinances concerning condemnations, from other cities in Arkansas.

New Business:

    1. Dogs – to decide in May whether to take off agenda    
    2. Bowen reported Mike Hartwig had heard back from Dollar General and wants to proceed with sale to the Town.  Resolution 03-13, a resolution authorizing the purchase of property (121 W. Rose) from Mike Hartwig, according to the terms and conditions outlined in the Offer and Acceptance, and authorizes Mayor O’Dell and R/T Bowen to execute all contracts and necessary documents for the purchase of said properties, was read in its entirety.  Ald. Gregory, seconded by Ald. Sullivan, moved Resolution 03-13 be approved.  All approved.  Motion carried.
    3. Avoca resident Jennifer from Courtney Lane called the office and filed a complaint concerning the burned out house on Pearl and the unsightliness of another home on Pearl.  During our discussion, the possible Town purchase of the Hartwig property was brought up.  Jennifer would love to help the Town with layout and landscaping of property.
    4. Mayor O’Dell reported he had an offer of $150 for the zero turn Troy Built mower that has been replaced with the Bad Boy.  Ald. Shields, seconded by Ald. Barnes, moved the Town accept offer.  All approved.  Motion carried.

Ald. Shields moved the meeting be adjourned at 8:15 PM. Ald. Barnes seconded the motion.  All approved.  Motion Carried.

          Meeting was adjourned by acclamation.
