Mayor O’Dell called the regular meeting to order at 7:00 PM and declared a quorum was present.

Pledge of Allegiance.
Moment of silence.

Consent of agenda:
September 24 planning commission meeting was added to announcements.

The minutes of August 13 were approved by acclamation.  Bowen noted the apple shed recipient and the proclamation to be presented at the annual picnic were not in the August minutes.

August 2013 financial report was approved, as presented, by acclamation.  Bowen to add a line to report for the new state ½ cent sales tax with a running total. 

Avoca Fire & Rescue
Fire Chief Elliott gave a report to Council.

NEBCO EMS – no report

Planning/Zoning –
Chairman Sullivan reported the committee met August 27 to discuss road, sidewalk and open channel specifications.  Roger’s specifications are being used as a guideline.

Zoning Official Shirley McDaniel was not present but did submit a written report.

Committee Reports:

  1. Clean-Up – Fall clean-up will be Saturday, October 26.  Bowen has registered the event with Great American Clean Up.
  1. Streets    

a. Mayor O’Dell reported he believes we had approximately $292,000 in damages from the flooding.  This is based on repair work we have done in the last three years.  Mayor O’Dell has talked with JP Mike McKenzie and he has looked over Rader Road.  He has also talked with State Representative Sue King about the damages to Prairie Creek, Woods Lodge/BC 74 and Rader Roads.  She is to get back with the Mayor after looking over the numbers.  He needs to get more information on what we can do and how the money is paid out.  He believes it is 25/75.  (25% town/75% state)

b. Johnny Johnson has been given the OK to do the job  on Chinook Drive.  Bid was $2100.

3.  Street and Traffic lights – all in working order


a. ‘Depot pavilion’ sign has been re-hung.

b. Avoca Disc Golf Course  grand opening will be Saturday, September 21, in conjunction with the community picnic. Sponsors for holes are being solicited.

c. Signs showing disk golf course and rules of game have been framed and are ready to be installed.

d. Sand for volleyball court and sand box and fines for the park have been delivered.  Bowen reported Ar. Line Marking, the company that did our crosswalks, will give us a bid on sealing the walking trail.  Horse shoe pit is open and horse shoes need purchased.                 

e. Bowen reported she contacted Jason Evans concerning the suggestions for a hydration station for bike cyclists   and ‘share the road’ signs on Old Wire and Prairie Creek Roads.  Mr. Evans said most of the cyclists like to go to the Avoca One Stop for cold water and food but thought the ‘share the road’ type of signs would go a long way.  Bowen to look into getting street signs (4) ordered.

f. Bike racks to come out of 2014 park budget.

5.  Town web site – up to date

Business Permits

a. New permit was issued to Aaron Kimball for TCB Mixed Martial Arts.  Mr. Kimball changed location to 499 S. Highway 62.

b.  Bowen reported two new businesses have recently opened on Tucks Chapel Road, without business permits. One business is doing vehicle repairs and the other used car sales.  Bowen was instructed to turn the information over to Little Flock police.

Building permits – none issued

Unfinished Business:

  1. Duplexes on Rose Street –

Bowen reported there was a commissioner’s sale on September 9 for the properties at 300 E. Rose and 301 E. Rose.  According to First Federal Bank they got both properties back.  Bowen to let our contact with First Federal Bank know about duplexes in our zoning code.

  1. Leroy Connolly property at 298 Pearl Ave. is much improved.  Can be taken off agenda.
  2. Bowen reported she contacted Core Logic again concerning the Daves property at 405 Smith Ridge Turn Off that still needs mowed. Core Logic gave the Town an email address that can be used for code violations.  To be turned over to Little Flock.
  3. The Mencl property at 309 Sheppard Road has shown no improvements with their unsightly and unsanitary conditions.  They have moved from the residence and are back again.  Bowen to turn over the violations to Little Flock police.

New Business:
1.  Ald. Eversole, seconded by Ald. Sullivan, moved the rules be suspended and Ordinance No. 96, an Ordinance requiring licenses for the privilege of carrying on a   business within the Town of Avoca and repealing Ordinance No. 79, be placed on its seconded reading, by title only.

Roll Call:  Ayes:  ALD.:  Sullivan, Eversole, Pinkley, Barnes, Gregory

Motion carried.

Ordinance No. 96 was read by title only.

Ald. Eversole, seconded by Ald. Barnes, moved the second reading of Ordinance No. 96 be accepted.

Roll Call:  Ayes:  ALD:  Pinkley, Eversole, Barnes, Gregory

Nay:  Ald. Sullivan

Motion carried.

2.  Mayor O’Dell, Ald. Gregory, Ald. Barnes, Ald. Sullivan and R/T Bowen met again and discussed plans/vision for new property. Fencing, driveways, asphalting, etc. was discussed. Ald. Gregory is going to make a suggestion box for a name of the new property.  We will put out the suggestion box during the community picnic.

3. Bowen reported the evaporator coil for the air conditioner has been repaired and the water leak has been fixed.  Tom Bramlett, A-Z Inspections, is to do an inspection on the mold September 12.

4.  Bowen will be on vacation the week of October 7th.  October council meeting will be    changed to Wednesday, October 16.  Committee will meet at 6 PM.

5.  Kathy Hansen will be the 2013 Apple Shed recipient and will also be presented with a proclamation for her service to the Town.

6.  Bowen to order ‘town’ magnet signs for David Olson’s vehicle.  Florescent t-shirts were also discussed.

7.  Off road vehicles related to zoning code and unsightly conditions were discussed.

Meeting was adjourned at 8:20 PM on a motion by Ald. Sullivan and seconded by Ald. Barnes.  All approved.  Motion Carried.
