Public forum

Ozy Murphy addressed the council concerning building The Avoca Oaks and Ozy Community Stores off of Hvvy 62. Mr. Murphy will keep the council posted as more informatio n becomes available. Jason Evans informed council he would like to have a Cycle Cross event like he held last year. He would like to close the street in front of town hall and use both sides of the park for the two-day event starting Saturday, December 1st and ending Sunday, December 2nd. Counci l mem bers asked q uest ions and voice d some concerns that Jason Evans answered.

  7. Computer Back up- Benjamin Dodge with Need Geek updated the town computer with a new back-up system for the price of$512.99 (software & labor). He will come check the computers every quarter to make sure everything is running smooth.
  8. Election Filing- Rec/Tres. Barnes reminded council members that Friday, August 17, at noon is the deadline for filing.

Committee Reports:

  1. Planning commission - Aid. King
    1. The Zoning Book is being cleaned up and will be presented to council for approval when finished per Aid. King.
    2. Aid. King infonned council, Zoning official Larry Parrish, Rec/Tres. Barnes and himself met with town attorney McClure concerning the Ruiz property o n Tucks Chapel Road. Attorney McClure informed council it was decided to fine Mr. Ruiz $1000.00 ($500.00 per offense) for being out of compliance and a lette r was sent to Blue & Associates to inform them. This fine will need to be paid and a building permit will need to be obtained. They were also informed, before the lot split can me approved, they need to show the 2 lots can perk.
  2. Board of Zoning Adjustments - Aid. King
    1. Meeting was held July 17th after the Planning meeting per Aid. King - no new business.
  3. Zoning and code enforcement- Larry Parrish

  4. Streets - Aid. Whitehorn
    1. Road damage due to flooding
      1. FEMA Update - Bid specifications were published on August 6th per Aid. Whitehorn
    2. Hwy 62 & Rose/Russell - Mayor O' Dell and Aid. Whitehorn informed council they were working on options to get a turn signal at Hwy 62 & Rose/Russell.
  5. Park - Aid. Hansen
    1. Steam Whistle Depot - Aid. Hansen informed coW1cil the pad has been poured for the new pavilion. Mayor O'Dell informed council he has received a bid from Rick Austin for the frame work and metal roof at a cost of $14,360.00 plus labor. A motion was made by Aid. Hansen to have Rick Austin do the metal work for the new pavilion at a cost of $14,500.00 plus labor. Seconded by Aid. Simons. All approved. Motion carried.
    2. Electric Sign - Aid. Hansen informed council the sign is up and running.
    3. Cycle Cross Event - AId. King asked Jason Evans if the bikes will rip up the grass in the park. Jason Evans, said it will be a possibility. Jason Evans has agreed to pay for any damage to the park if any do occur during the event. A motion was made by Aid. Hansen to approve Jason Evans to close the street in front of town hall and to hold a Cycle Cross event on December is 19 and 21

  7. Future of Avoca - Aid. Hansen & Aid. Simons
    1. Town attorney McClure informed council there is no prohibition against sen ding letters to solicit folks to annex into our town. b. Aid. Hansen has talked to Hoss Cameron; Hoss's RV Repair & Restoration about getting an Avoca Business Association together.

  1. Transportation Alte rnatives Program (TAP) - Avoca Heritage Trail -Aid. Pinkley

  3. Impa ct Fees - sponsored by Ald. Hansen; Town Attorney McClure is looking into Impact fees to help with the town roads.
  4. Tornado Siren -Aid. Simons informed council members the options and cost of a tornado siren. Council has decided to take no action at this ti me.

New Business

  1. Town Picnic/Firemen's BBQ- Recff res. Barnes let the council know the picnic will be held Saturday September 29th Mayor O' Dell mentioned Hoss Cameron and the VFW would like to help if needed.
  2. Ordinance 121-Rules andRegulations for Mobile Food & Outdoor Venders; A motion was made by Aldermen Hanson and seconded by Aldermen Whitehorn to place Ordinance 121 o n its first reading. Roll call; Alde rm e n King: yes, Aldermen Simons: yes, Aldermen Whitehorn: yes, Aldermen Hansen: yes, and Aldermen Pinkley: yes. All approved, motion carried. Attorney McClure read Ordinance 121 in its entirety. A motion was made by Aldermen Hansen to accept Ordinance 121 on its first reading. Seconded by Aldermen Simons. Discussion: Quest ions were asked and answered concerning if the ordinance covers all outside venders.
