A quorum was declared by Vice Chairman Mills and the meeting was called to order at 6:31.

Motion made by A. Brewer to accept minutes from February 20, 2018. Seconded by R. Etoll. Motion carried.

Committee Reports

Nanette Barnes shared the town will have Benton County inmates cleaning trash on town streets week of March 26.

Old Business

  1. Discussion was held regarding Unsightly and Unsanitary Conditions Ordinance No. 110. Chairman King had asked Commission members to review current ordinance prior to meeting. Mayor O'Dell stated Planning Commission should not have jurisdiction over unsightly and unsanitary conditions. He continued to say complaints of unsightly or unsanitary should be brought before the Town Council not the Planning Commission. C. Pinkley read Ordinance No. 110, Section 3, Initial Determination of Unsightly and Unsanitary Condition aloud. Mayor O'Dell expressed concerns over complaints under this ordinance being brought to Planning Commission prior to Council. Commission members questioned the sequence of the ordinance being passed in relation to past Planning Commission discussions of zoning regarding animals and the Marheineke pool. C. Pinkley read the minutes from the May 16, 2017 Planning Commission meeting which state: "No action was taken on zoning code in regards to number of animals on property...Planning Commission members expressed applying ordinance currently in place regarding unsightly and unsanitary property to problematic animal issues." C. Pinkley then read Planning Commission meeting minutes from September 19, 2017, under New Business, "Ordinance No. 110, Unsightly and Unsanitary, J. King requested all members to inspect the pool at Dale Marheineke residence." C. Pinkley stated Commission members were given a copy of Ordinance No.110, dated September 12, 2017, at that same meeting(September 19, 2017).
  2. Road proposal working session will be scheduled after Nanette Barnes has secured a copy of topographical map.

New Business

  1. Unsightly and Unsanitary ordinance was discussed. Mayor O' Dell stated his intention to talk to Town Council in regards to the oversight of Ordinance No 110.
  2. Property between Old Wire Road, Prairie Creek Road and Dancer Road is for sale (62 acres).

    Subdivision is a possibility. Barnes will get a copy of current Town of Avoca Subdivision Regulations to R.
    Etoll. All Commission members were asked to study current Subdivision Regulations and Comprehensive Land Use Plan prior to road proposal working session and/or next Planning Commission meeting.

Announcement

Town of Avoca Easter Egg hunt is Saturday, March 24. Volunteers are needed to hide eggs at 9:15. Hunt begins at 10:00.

April meeting of Planning Commission is set for April 17, 2018 at 6:30.

Motion was made to adjourn at 7:10 by A. Brewer. Seconded by R. Etoll. Motion carried.
